FREEBYTES ONLINE STORE - CONDITIONS OF USE AND SALE

These Conditions of Use and Sale govern access to, browsing of and use of the FREEBYTES online store, as well as sales contracts concluded through it. By visiting the website, creating an account, submitting an order or using any function of the store, the user acknowledges the terms applicable to that use or transaction. Acceptance of these terms may never be interpreted as a waiver of rights mandatorily granted under Greek or European Union law.

These terms should be read together with the Shipping & Returns page, the Privacy Notice, the information displayed on each product page and the information shown during checkout. If any term conflicts with a mandatory legal provision, the mandatory provision prevails.

Customers may use the above contact details for questions relating to products, orders, payments, shipping, withdrawal, returns, technical support, lack of conformity, commercial guarantees and any other matter connected with a transaction with the online store.

2. Scope

These terms apply to transactions completed through the online store and, where appropriate, to transactions initiated by telephone or electronic communication. Certain provisions apply specifically to consumers, meaning natural persons acting for purposes outside their trade, business, craft or profession. Purchases made in the course of professional or business activity may be subject to different rules to the extent permitted by law.

3. Use of the website

The website is provided for lawful information, product search, order placement, account management and communication with FREEBYTES. Users must use the website in a way that does not breach applicable law, interfere with system operation, attempt unauthorised access to data or accounts, or prevent other visitors from using the service.

Use of malicious software, unauthorised data-extraction techniques or mechanisms intended to circumvent technical protection measures or gain access to information not intended for public use is prohibited.

4. Customer account

Where account creation is available, users must provide accurate information and keep access credentials confidential. The account is intended for the personal use of the account holder. Users should notify FREEBYTES if they become aware of unauthorised use or any other security breach.

Having an account is not a prerequisite for exercising a right which the law permits to be exercised without logging in. The electronic withdrawal function can also be used by a customer who does not have an active account, provided that the relevant order can be securely identified.

5. Products, descriptions and technical specifications

FREEBYTES uses reasonable efforts to ensure that product descriptions, technical specifications, images, compatibility information, functions and supplied accessories are accurate and current. Technology and radio-communications products may be subject to firmware revisions, minor production changes, packaging variations or changes to supplied accessories by the manufacturer where those changes do not materially alter the contractual identity of the product.

Photographs are primarily informative and may not always reproduce colour, scale or minor aesthetic differences with absolute accuracy. This does not restrict the obligation to supply goods that conform to the contract or the customer's rights where there is a material departure from the agreed characteristics.

6. Product availability

Availability information reflects the best information available at the time it is displayed. However, because a short period may occur between two orders or between an actual stock change and an update of the system, it is possible in exceptional cases for a product displayed as available to have just sold out or to require confirmation from a supplier.

Where an item is unavailable or materially delayed, the customer is informed without undue delay. If a change in delivery time, product substitution or another material change is required, it is not imposed unilaterally where the customer's agreement is legally required.

7. Prices, taxes and obvious errors

Prices shown in the online store include applicable VAT where relevant. Shipping charges, cash-on-delivery charges or other additional fees are shown before final order submission where they can be calculated in advance.

Particular care is taken to ensure pricing accuracy. In the event of a demonstrable and obvious technical or typographical error, especially where the displayed price is manifestly inconsistent with the nature and normal commercial value of the product, FREEBYTES will contact the customer before fulfilment. This provision does not constitute a right to alter a normally established and accepted price arbitrarily.

8. Promotions, discounts and cashback

Where the online store announces a price reduction or displays a reference price next to a reduced price, the rules of applicable law concerning the prior price and transparent consumer information are followed. Concepts such as a manufacturer's recommended retail price, catalogue price, bundle price, a genuine store price reduction and manufacturer cashback must be presented in a way that does not create confusion as to the nature of the economic benefit.

Manufacturer promotions, such as cashback paid by a third party and not by FREEBYTES, may be subject to additional terms, deadlines, registration, submission of proof of purchase or geographic restrictions imposed by the manufacturer itself. Final payment of cashback depends on compliance with the conditions of the entity providing it.

9. Order process

The customer selects products and quantities, enters or confirms delivery and billing information, selects an available payment and shipping method and can review the order before final submission. The customer is responsible for the accuracy of the information entered, especially name, address, telephone number, email address and billing details.

After submission, a corresponding record is created in the system and an acknowledgement is displayed or sent. An automated acknowledgement of receipt does not necessarily mean that all objective fulfilment conditions, such as availability, successful payment or ability to deliver, have already been checked.

10. Acceptance and fulfilment of orders

FREEBYTES does not reserve a general and unlimited right to cancel orders arbitrarily. Any cancellation or non-fulfilment must be based on a genuine reason such as lack of stock, payment failure, obvious error, inability to deliver, suspected fraud, unlawful transaction or another objective cause.

11. Payments

Available payment methods are displayed during checkout. Card payments are processed through the cooperating payment-services provider or banking institution. FREEBYTES should not be understood as storing full card details unless this actually occurs through an appropriate infrastructure and is expressly described in the Privacy Notice.

Where pre-authorisation or reservation of funds is used, the exact timing of release following cancellation may also depend on the banking system or payment provider and not solely on FREEBYTES.

12. Shipping and delivery

Detailed terms concerning shipping, indicative delivery times, carriers, remote areas and practical delivery arrangements are set out on the Shipping & Returns page. Dispatch time from the store and transit time after collection by the carrier are separate periods.

13. Risk of loss or damage during transport

For a consumer sale using a delivery method offered by FREEBYTES, the risk of loss or damage does not pass to the consumer merely because the parcel has been handed to the courier. Risk passes when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

Where the consumer independently chooses a carrier that is not offered by FREEBYTES and commissions that carrier directly, the specific statutory exception applies.

14. Right of withdrawal

A consumer entering into a distance contract has, subject to statutory exceptions, the right to withdraw without giving any reason within the statutory period. Detailed information on the start of the period, return of goods, reimbursement, diminished value and exceptions is set out on the Shipping & Returns page.

FREEBYTES provides a dedicated Electronic Withdrawal Function through which the customer can submit the declaration electronically, select the products concerned and receive an acknowledgement of submission. The electronic function is an additional method and does not exclude any other unequivocal statement permitted by law.

15. Condition of goods when exercising withdrawal

Opening the packaging does not automatically remove the right of withdrawal. The consumer may inspect the product to the extent necessary to establish its nature, characteristics and functioning. If the product is handled beyond what is necessary for that examination, the consumer may be liable for the diminished value caused by such additional handling.

Original packaging, accessories, manuals, cables, brackets, microphones, chargers and other components supplied with the product affect its commercial value and should, where possible, be returned with it.

16. Exceptions to the right of withdrawal

The right of withdrawal does not apply in cases expressly excluded by law. Examples may include goods made to the customer's specifications or clearly personalised, sealed goods not suitable for return for health-protection or hygiene reasons once unsealed, sealed audio/video recordings or software once unsealed, goods inseparably mixed with other items after delivery and certain forms of digital content where the specific statutory conditions are met.

The personalised-goods exception does not automatically apply to every product that has merely been configured, programmed or selected from standard available options. The actual circumstances of the order must be considered.

17. Statutory liability for lack of conformity

FREEBYTES, as seller, is liable to the consumer where delivered goods do not conform to the contract under the conditions laid down by applicable law. Statutory liability for lack of conformity is independent from the right of withdrawal and from any manufacturer's commercial guarantee.

The product must, among other things, correspond to the agreed description, type, quantity and quality characteristics and be fit for the ordinary purposes of goods of the same type and, where applicable, for any particular purpose accepted at the time of contracting.

18. Repair and replacement

Where goods lack conformity, the consumer may, subject to the statutory conditions, choose between repair and replacement. The chosen remedy may be refused only if it is impossible or, compared with the alternative, would impose disproportionate costs on the seller taking into account the value of the goods, the significance of the lack of conformity and whether the alternative can be provided without significant inconvenience to the consumer.

Repair or replacement is carried out free of charge, within a reasonable period and without significant inconvenience. Before the remedy is provided, the consumer receives the information required by applicable law concerning the right to choose between repair and replacement and the consequences associated with choosing repair. For movable goods, where the relevant provision applies, choosing repair is linked to the statutory three-year limitation period.

19. Price reduction and termination

Where bringing the goods into conformity is impossible, is not completed as required by law, the lack of conformity reappears or another statutory ground applies, the consumer may be entitled to a proportionate reduction in price or termination of the contract, subject to the detailed conditions of applicable law.

20. Manufacturer commercial guarantees

Certain products are supplied with a commercial guarantee from the manufacturer or supplier. A commercial guarantee is an additional benefit and does not restrict the seller's statutory liability or the consumer's rights under law. Its duration, geographic scope, authorised service centres and specific terms are determined by the guarantor.

21. Technical examination of products

Complex electronic equipment may require technical examination in order to establish the actual symptom, cause of failure and appropriate remedy. Technical examination is not used as a means of denying statutory rights but as a process for determining the relevant technical facts.

If the issue is shown to result from an incompatible external installation, incorrect power supply, unauthorised intervention, unlawful modification or another external cause, the matter is handled on the basis of the actual findings and the applicable guarantee terms and law.

22. Radio equipment and lawful use

Certain radio equipment requires, for lawful operation, a licence, a particular category of authorised user, compliance with frequency and power limits, emission type or other regulatory conditions. Purchasing equipment from FREEBYTES does not itself grant an operating licence and does not relieve the user of the duty to comply with applicable law.

For amateur-radio or professional equipment in particular, the purchaser is responsible for determining whether the required authorisation or operating right is held. PMR446 equipment and other specific categories are subject to their own technical and regulatory limits.

23. Software, firmware and digital functions

Goods containing digital elements may depend on firmware, applications, third-party services, operating systems or manufacturer infrastructure. FREEBYTES does not independently control third-party services, but this does not restrict obligations imposed by law where the digital element forms part of the contractual functionality of the goods.

Users should follow manufacturer instructions concerning updates and safe operation, particularly where an update is necessary for security, compatibility or continued proper functioning.

24. Reviews and user content

Where a review or comment function is available, content must not be unlawful, threatening, defamatory, misleading, infringe third-party rights, contain malicious software or constitute unsolicited commercial promotion.

FREEBYTES may remove content that breaches the law or these terms. Where a review is presented as originating from a verified purchase, appropriate measures must have been taken to ensure that the representation is accurate.

25. Intellectual and industrial property

Texts, structure, graphics, logos, photographs owned by FREEBYTES, website design and other original content are protected under applicable intellectual and industrial property law. Third-party trademarks, photographs, technical manuals, logos and other materials remain the property of their respective rights holders.

Systematic copying, republication or commercial exploitation of protected content without permission is prohibited unless the use is permitted by law.

26. Website security and availability

FREEBYTES uses reasonable efforts to operate the online store securely, reliably and continuously. Maintenance, infrastructure failures, provider issues, cyberattacks, software updates or other external factors may nevertheless cause temporary interruption or malfunction.

A technical malfunction does not remove rights already arising from a valid transaction. Where a system problem affects an order or customer statement, the available evidence is examined and the appropriate lawful solution is applied.

27. Limitation of liability

FREEBYTES is not responsible for loss caused exclusively by unlawful use of a product, failure to follow instructions, incompatible modifications, external installations or circumstances unrelated to any legal responsibility of the seller. Any limitation of liability applies only to the extent permitted by law.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited and nothing restricts a mandatory consumer right.

28. Personal data

Processing of personal data is described in the Privacy Notice. Information supplied in connection with an order is used for contract performance, invoicing, shipping, communication, statutory accounting and tax documentation and other purposes described in that notice.

Submission of a withdrawal statement involves processing data necessary to identify the order, evidence the time and content of the statement, communicate with the customer, manage return of goods and reimbursement and retain the documentation required by law.

29. Electronic communications

Communication may take place by email, through the online store or by another appropriate means. Electronic methods may be used for confirmations, acknowledgements and notices to the extent that the applicable legal requirements for clear information and, where required, provision on a durable medium are met.

30. Changes to these terms

FREEBYTES may update these terms where legislation, operation of the online store, shipping or payment methods, technical infrastructure or other factual circumstances change. Amendments apply to future transactions from the time they are published unless the law provides otherwise.

A later amendment does not retroactively alter the essential terms of a contract already concluded unless the change is permitted by law, is favourable to the customer or is lawfully agreed by the parties.

31. Applicable law

These terms and transactions with FREEBYTES are governed by Greek law, without prejudice to mandatory consumer-protection rules and rights granted by applicable European Union law. The choice of Greek law does not deprive a consumer of mandatory protection available under rules applicable to a particular cross-border case.

32. Dispute resolution

Where a problem or disagreement arises, customers are encouraged to contact FREEBYTES first so that the relevant facts can be examined and a practical solution sought. This does not restrict any right to approach a competent authority, an alternative dispute-resolution body where applicable, or a court.

The former European Online Dispute Resolution (ODR) platform is no longer an active European mechanism and for that reason no link to it is provided.
